Sales Terms and Conditions

Parties

These sales terms and conditions are established between Sun Society (hereafter referred to as "Sun Society") and any individual or entity wishing to make a purchase through the website sunsociety.com (hereafter referred to as "the Buyer").

Purpose

These sales terms and conditions aim to define the contractual relationship between Sun Society and the Buyer, and the terms applicable to any purchase made through the Sunsociety.com online store, whether the Buyer is a professional or a consumer.

Purchasing a product or service through this site implies the Buyer’s unconditional acceptance of these sales terms and conditions. These terms will take precedence over any other general or specific terms not expressly agreed upon by Sun Society. Sun Society reserves the right to modify its sales terms and conditions at any time. In such cases, the terms applicable will be those in effect at the time of the Buyer’s order.

Product and Service Features

The products and services offered are those listed in the catalog published on Sun Society’s website. These products and services are available only while stocks last. Each product is accompanied by a description provided by the supplier. Catalog photographs are as accurate as possible but may not perfectly resemble the actual product, particularly regarding colors.

Pricing

Prices listed in the catalog are inclusive of VAT in euros and reflect the applicable VAT rate at the time of the order. Any changes in VAT rates may affect the product or service prices. Sun Society reserves the right to change its prices at any time, but the price listed in the catalog at the time of the order will be the only one applicable to the Buyer. Prices do not include order processing, shipping, or delivery fees, which are calculated based on the delivery areas mentioned below.

Geographical Area

Online sales of the products and services presented on the site are reserved for Buyers residing in France. Unless otherwise stated on the site during the ordering process or in the product descriptions, Sun Society commits to delivering products within a maximum of thirty (30) days from the conclusion of the contract with the Buyer.

Orders

To purchase a product or service, the Buyer must:

  • Fill out the identification form with all requested details or provide their customer number if applicable;
  • Complete the online order form with all the references of the selected products or services;
  • Confirm their order after verifying it;
  • Make the payment as specified;
  • Confirm the order and payment.

Order confirmation signifies acceptance of these sales terms and conditions, acknowledgment of having read them thoroughly, and waiver of any other purchase conditions or terms. The provided data and confirmed details will serve as proof of the transaction. The confirmation acts as a signature and acceptance of the transaction. The Seller will send an email confirming the recorded order.

Exchanges will not be possible. Upon receiving your return, we will refund the jewelry, excluding shipping costs.

Right of Withdrawal

Consumers have a fourteen-day period from the receipt of their order to return the product to the Seller for a refund without penalty, except for the initial shipping costs (note that return shipping costs are the responsibility of the Buyer).

Payment Methods

Payment is required at the time of ordering. Payments will be made by credit card through a secure system that uses SSL (Secure Socket Layer) protocol to ensure that transmitted information is encrypted and cannot be accessed by third parties during network transmission. The Buyer’s account will be debited upon placing the order for available products or services and the amount of products or services sent. A paper invoice showing VAT can be issued upon the Buyer’s request.

Deliveries

Deliveries are made to the address specified in the order form, which must be within the agreed geographical area.

Packages are shipped within 1 to 2 days. Standard delivery: 2 to 5 business days after shipment, depending on the carrier’s timelines.

Risks are the responsibility of the Buyer from the moment the products leave Sun Society’s premises. In case of damage during transport, a justified claim must be made to the carrier within three days of delivery. Delivery times are indicative; if they exceed thirty days from the order date, the sales contract may be canceled, and the Buyer refunded.

Sun Society is not responsible for lost packages after the carrier's official delivery confirmation. Once your package is marked as delivered, our responsibility ceases. No refund will be issued in this case.

For deliveries to pickup points, the package must be opened and checked before signing. After the customer’s signature, no claims will be accepted.

Warranty

For any claims regarding your order, please contact customer service via email at contact@Sunsociety.com within a maximum of 72 hours from receiving your package.

The warranty does not apply beyond 30 days from the receipt date.

All products supplied by the Seller benefit from the legal warranty provided by Articles 1641 and following of the French Civil Code.

If a product is non-compliant, it can be returned to Sun Society, which will refund it as store credit on Sunsociety.com. All claims or refund requests must be made by email to: heu@Sunsociety.com

Claims for an order will not be accepted beyond 30 days from the invoice date.

Liability

The Seller is only bound by an obligation of means in the online sales process; their liability cannot be engaged for damages resulting from the use of the Internet such as data loss, intrusion, viruses, service interruption, or other involuntary issues.

Intellectual Property

All elements of the "sunsociety.com" site are and remain the intellectual and exclusive property of Sun Society. No one is authorized to reproduce, exploit, redistribute, or use any elements of the site, whether software, visual, or sound, in any manner or partially. Any simple or hyperlink is strictly prohibited without Sun Society’s written consent.

Personal Data

In accordance with the French Data Protection Act of January 6, 1978, personal data of Buyers may be subject to automated processing. Sun Society reserves the right to collect information on Buyers, including using cookies, and, if desired, to share collected information with commercial partners. Buyers may oppose the disclosure of their details by notifying Sun Society.

Users also have the right to access and rectify their data according to the January 6, 1978 law.

Archiving - Proof

Sun Society will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with Article 1348 of the Civil Code. Sun Society’s computerized records will be considered proof of communications, orders, payments, and transactions between the parties.

Dispute Resolution

These online sales terms and conditions are governed by French law. In the event of a dispute, jurisdiction is assigned to the competent courts of Nanterre, notwithstanding the presence of multiple defendants or appeals for indemnity.
